Welcome to ChiPeJ Auction Systems, a Zimbabwean-based online auction platform operated exclusively by ChiPeJ Systems (Pvt) Ltd. These Terms and Conditions govern your use of our auction website located atย  https://auctions.chipej.co.zw ย (โ€œWebsiteโ€). By accessing or using this Website, you agree to comply with and be bound by these Terms and Conditions. If you do not agree, please do not use this Website.

1. Business Model and Eligibility

ChiPeJ Systems (Pvt) Ltd operates as the sole vendor on this platform. Users may submit goods to ChiPeJ Systems (Pvt) Ltd on consignment, and ChiPeJ Systems (Pvt) Ltd will, at its discretion, list such items for auction on their behalf.

To participate in the auctions or submit items for consignment:

  • You must be at least 18 years of age.

  • You must be legally capable of entering into binding agreements under Zimbabwean law.

  • You must provide accurate and complete registration information.

2. Consignment of Goods

Users may submit goods to ChiPeJ Systems (Pvt) Ltdย for auction under a consignment agreement. The following terms apply:

  • ChiPeJ Systems (Pvt) Ltd reserves the right to accept or reject any item at its sole discretion.

  • Upon acceptance, ChiPeJ Systems (Pvt) Ltd will list the item(s) on the Website and manage the entire auction process.
  • A Commission or handling fee (at the applicable rate) shall be deducted from the final sale amount, together with the Value Added Tax (VAT) and the balance will be paid to the consignor within an agreed timeframe after the successful sale.
  • A Purchaserโ€™s Levy or handling fee (at the applicable rate) shall be added on the final bid price on successful bids, and the balance shall be settled by the winning Bidder.
  • By signing these Terms and Conditions and using the Website, consignors do hereby declare full ownership of the item and warrant that it is legal to sell the item under Zimbabwean law.For full details on all applicable fees and charges, please contact [email protected] .

3. Auction Process

ChiPeJ Systems (Pvt) Ltd lists and auctions all items on the platform in the condition they were consigned in, without any modifications. Bidders may place offers on items available for auction with the following conditions:

  • All bids are final and legally binding.
  • All bids cannot be revoked or removed or deleted by the Bidder.
  • The highest Bidder at the close of the auction is deemed to have entered into a contract to purchase the item.
  • ChiPeJ Systems (Pvt) Ltd reserves the right to cancel or delete any bid offer if there is any violation of the Terms and Conditions.
  • ChiPeJ Systems (Pvt) Ltd reserves the right to extend, pause, or cancel auctions if technical issues or irregularities occur.

4. Payments and Payouts

Payments are currently cash at the company premises. Online payments will be allowed in due course. By placing a winning bid or making a purchase, you agree to:

  • Settle payment within the 48 hrs after auction close (or two working days).

  • Use only approved payment methods allowed by ChiPeJ Systems (Pvt) Ltd.

  • Accept that ChiPeJ Systems (Pvt) Ltd is not responsible for errors, delays, or security breaches regarding payments.

  • All payouts shall only be made after the successful Bidder has paid for the item(s).

  • Deposit refunds shall be made upon meeting all conditions of the auction(s).

  • Deposit refunds greater than $4,000 shall require a notice and pre-arrangement.

  • The ChiPeJ Auctions platform operates on the USD currency by default, for all transactions. However, other currencies that are legal tender in Zimbabwe may be accepted for payments or payouts only by prior arrangements with management.

5. Fees and Commission

  • All items sold on consignment are subject to a commission fee, deducted from the final sale price.

  • Buyers may also be charged a Buyerโ€™s premium or handling fee or a purchaserโ€™s levy, where applicable.

  • All applicable fees are disclosed prior to bidding or selling.

  • All prices and payments are processed in US Dollars (US$), unless otherwise specified.

  • The onus is on the Sellers & Buyers to request/enquire about the applicable fees and commission before consigning or bidding.

  • Goods will only be released upon positive verification that funds have been received from any platform used.

  • Goods will only be released to someone upon positive identification of the registered Bidder. If a Bidder is not able to collect in person, and proxy shall be appointed and the registered Bidder shall notify ChiPeJ Systems (Pvt) Ltd of such an arrangement.

  • VAT will be applied on the commission charged as well as on the purchaserโ€™s levy.

6. Charges Applicable to Sellers

All charges listed below shall be subject to VAT at the current rate as determined by ZIMRA.
As at May 2025, the VAT is 15%.

Commission on Sellers (COMMISSION OR HANDLING FEES)
1. When a seller comes to collect his dues, any items sold on the auction platform shall be subject to a commission or handling fee as shown in the table below.
2. VAT at 15% shall be applied on the charged on the commission. VAT will change according to the dictates of the authorities.
3. The commission and the VAT shall be added together and the sub-total shall be deducted from the winning bid to determine the amount that a seller will receive on payout.

Example:
Sofas bought for $300 as final winning bid.
Winning Bid = $300.00
Less Commission @ 12% = $36.00
Less VAT on Commission @ 15% = $5.40
TOTAL PAYOUT TO SELLER: = $258.60

Requirements for Sellers to Consign Goods
1. Physical registration at the company offices
2. National ID number
3. Proof of residence or Affidavit

7. Charges Applicable to Buyers

All charges listed below shall be subject to VAT at the current rate as determined by ZIMRA.
As of May 2025, the VAT is 15%.
Charges on Buyers (PURCHASERโ€™S LEVY)
When a Buyer comes to pay and collect any winning bids, any item bought on the auction platform by the Buyer, shall attract a handling fee OR BUYERSโ€™ PREMIUM of 10%, regardless of the value.

Example:
Sofas bought for $300 as final winning bid.
Winning Bid = $300.00
Add Purchaserโ€™s Levy @ 10% = $30.00
Add VAT on Purchaserโ€™s Levy @ 15% = $4.50
TOTAL AMOUNT TO BE PAID BY PURCHASER: = $334.50

Requirements for Buyers to Register
1. Sign up on the online registration form
2. Submit an ID on request

8. Prohibited Items

ChiPeJ Systems (Pvt) Ltd does not accept or auction the following:

  • Stolen, counterfeit, or illegal goods

  • Hazardous materials or explosives

  • Drugs or controlled substances

  • Items that infringe on intellectual property rights

  • Human remains, body parts, or wildlife products banned under law

The onus to verify all of the above lies entirely with the Consignor before consigning the item(s).

In the event of a violation of the above, ChiPeJ Systems (Pvt) Ltd will cooperate with law enforcement agents and may, in this instance, disclose the identity of sellers or buyers as necessary.

ChiPeJ Systems (Pvt) Ltd reserves the right to reject or delist any item that violates applicable Zimbabwean laws or these Terms.

9. User Conduct

By using this Website, you agree not to:

  • Submit fraudulent, stolen, fake, counterfeit, or misrepresented goods for consignment

  • Manipulate bidding through fake accounts or collusion

  • Interfere with the auction process or other users

  • Attempt to access restricted areas or compromise the platform’s security

ChiPeJ Systems (Pvt) Ltd reserves the right to suspend or terminate any account that violates these Terms and Conditions, and pursue legal action against the registered person.

10. Intellectual Property

All Website content, including text, images, code, trademarks, and logos, is the property of ChiPeJ Systems (Pvt) Ltd or licensed third parties. You may not copy, reproduce, or use any part of the Website without written permission.

11. Dispute Resolution

a. Buyer and Seller Disputes

As ChiPeJ Systems (Pvt) Ltd is the sole seller on the platform, any disputes regarding item condition, delivery, or non-payment will be resolved directly between ChiPeJ Systems (Pvt) Ltd and the buyer or seller.

b. Resolution Procedure

In the event of a dispute:

  1. Notify ChiPeJ Systems (Pvt) Ltd via email at [email protected] within 48 hours of receiving the item or the end of the auction.

  2. Provide detailed documentation of the issue (e.g., photos, descriptions) and the receipts or invoices thereto.

  3. ChiPeJ Systems (Pvt) Ltdย will review and respond within 5 business days with a proposed resolution, which may include (but not limited to) refund, exchange, or dismissal of the claim.

If a resolution is not reached, the matter may be referred to a neutral mediator or arbitrator in Harare, Zimbabwe, such as the Court of Law, whose decision shall be final and binding.

12. Voetstoots (Sold As Is)

All goods sold on the ChiPeJ Systems (Pvt) Ltd platform are sold voetstoots (i.e., as is), with all faults and imperfections, whether patent or latent. Buyers acknowledge and accept that:

  • ChiPeJ Systems (Pvt) Ltd acts as an agent for consignors and does not manufacture goods or guarantee the quality, condition, functionality, or suitability of items.

  • It is the responsibility of the buyer to inspect item descriptions, photographs, and ask any relevant questions prior to bidding on the viewing dates stipulated.

  • No warranties, guarantees, or representations are madeโ€”express or impliedโ€”unless specifically stated in writing.

  • ChiPeJ Systems (Pvt) Ltd shall not be liable for any defects, damage, or loss arising from the condition of any goods after the sale is concluded.

  • ChiPeJ Systems (Pvt) Ltd shall not be liable for any loss that may arise due to an act of God.

By placing a bid, the buyer expressly agrees to purchase the item in its current condition and waives any claims or recourse based on the condition or quality of the item post-sale.

13. Limitation of Liability

ChiPeJ Systems (Pvt) Ltdย shall not be liable for:

  • Losses resulting from payment gateway errors

  • Delays or failures in delivery due to third-party logistics

  • Indirect, incidental, or consequential damages arising from your use of the Website

  • ChiPeJ Systems (Pvt) Ltd will not be held liable for successful bids if the bidders fail to show up and honour their bids. The item shall be re-auctioned.

The maximum liability of ChiPeJ Systems (Pvt) Ltd shall not exceed the total fees paid to ChiPeJ Systems (Pvt) Ltd for the specific transaction giving rise to the claim.

14. Termination

ChiPeJ Systems (Pvt) Ltd may terminate or suspend user access to the Website at any time, with or without notice, for violations of these Terms and Conditions or suspected fraudulent activity. The user may also close their account by contacting ChiPeJ Systems (Pvt) Ltd.

15. Changes to Terms and Conditions

We reserve the right to update these Terms and Conditions at any time. Changes will take effect once posted to this page. Your continued use of the Website indicates your acceptance of the modified Terms and Conditions.

16. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Zimbabwe. Any disputes shall be subject to the exclusive jurisdiction of Zimbabwean courts.
